Safe buying of property in Ukraine Ukrainian Property Buying Guide

Buying property in Ukraine is the process pretty well-documented and the rights if foreigners are protected. So, you have to know ideally what are your rights and duties in order to remove the possibility of fraud and traps.

Now it is clear that this European country opened the gates for potential investors and Ukrainian property buyers presenting large amount and variability of property for sale in Ukraine. As the property market of Ukraine is pretty young, but intensively developing, the one willing to own a real estate here has to deal with diligent and good estate agent and solicitor, only then foreign buyers in Ukraine can make a successful investment.

In 2004 Ukraine adopted a new Civil Code - the Law of Ukraine on Property and Land Code - specifying the rights of foreign citizens wishing to own residential or commercial land or property in Ukraine.

At the moment foreigners are not restricted in their purchase and ownership, they can use and resale the real estate in Ukraine. Some foreigners prefer to buy property in this country by means of local limited company types structure in order to asset from undesirable attention.

The purchaser has to offer to a diligent solicitor as soon as possible before the real estate purchase is made. The next person who has to assist a buyer is definitely an estate agent. Ukraine is unfortunately the country that possesses a great number of swindle agents that want to charge both the buyer and vendor, so the buyer has to find a company/agent whom he can trust and rely on. As well the fees and payment for service (if it is needed for recommendations) should be negotiated in advance.

Once s property or piece of land is determined the next step is preparing of preliminary sale- purchase agreement between buyer and vendor. The country is obligatory should be checked by the buyer's solicitor (or sometimes this function is provided by the real estate company that is cooperating with buyer). There is usually at least 14 days gap between signing of preliminary contract and signing and verification of the final contract.

The vendor should provide the following documents:

  1) the certificate of privatization or contract ofprevious purchase or proof that the vendor owns the property as a result of inheritance

  2) a certificate from the Unified Register of Prohibitions on the Disposal of Immovable Property to prove that there are no outstanding debt or legal issues against the property for sale

If everything is found to be in order the sale-purchase agreement (final) is signed and verified by the notary, who will register the document in the State Registry (real estate in Ukraine company can also provide this service). This process takes several days. An investor should insist that a final balance of money is withheld until the registration process is complete.
